These Terms of Service ("Terms") govern your access to and use of Prestige Publishing House's website, services, and platform. By using our services, you agree to be bound by these Terms.
1. Services
Prestige Publishing House provides book publishing, editing, ghostwriting, cover design, marketing, and related services to authors. All services are subject to individual service agreements and scope of work documents.
2. Eligibility
You must be at least 18 years of age to use our services. By using our platform, you represent that you meet this requirement and are legally capable of entering into binding agreements.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activities that occur under your account.
4. Intellectual Property & Rights
Your Content: You retain ownership of your original manuscript and creative work. By submitting work to us, you grant Prestige Publishing House a limited license to use, edit, reproduce, and distribute your work solely for the purpose of providing the contracted services.
Our Content: All website content, logos, designs, and software are owned by Prestige Publishing House and protected by intellectual property laws. You may not copy, reproduce, or distribute our materials without written permission.
Ghostwritten Content: Work produced under ghostwriting agreements is owned by you (the client) upon full payment, as specified in your service agreement.
5. Payment Terms
Payment terms are as specified in your service agreement. Generally:
- 50% deposit is required before work begins
- Remaining balance is due before final delivery of files
- All prices are in USD unless otherwise specified
- Payments are processed securely via Stripe or PayPal
6. Prohibited Use
You agree not to use our services to:
- Submit plagiarized, defamatory, or illegal content
- Infringe on the intellectual property rights of others
- Attempt to gain unauthorized access to our systems
- Engage in fraudulent transactions or chargebacks
- Publish content promoting hate speech, violence, or illegal activity
7. Limitation of Liability
To the maximum extent permitted by law, Prestige Publishing House shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
8. Dispute Resolution
Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association, governed by the laws of the State of New York.
9. Termination
We reserve the right to suspend or terminate your account and access to services at our discretion if you violate these Terms. You may also terminate your account at any time by contacting support. Termination does not relieve you of outstanding payment obligations.
10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions.
